The Max plans provide five- and twenty-times the Pro plan’s usage capacity per session, respectively. They also include priority access to new models, access to Claude Code, and higher usage limits compared with the Pro plan. The differences between Pro and Max tiers consist of the usage multipliers and the additional access privileges for Max subscriptions.
Plaintiff Karl Kahn alleges he overpaid for both the Claude Pro and Claude Max subscriptions and that he received less usage than was advertised. He alleges he sometimes purchased additional usage after reaching plan limits. The complaint contends Anthropic made misleading statements about the amount of usage included with Claude Max plans. It also alleges Anthropic did not clearly explain how usage was measured. The complaint states that the lack of transparency may explain why no similar lawsuits had been filed previously and seeks to represent other subscribers who purchased Max plans.
Plaintiff Karl Kahn is represented by Kati Daffan of Vaca Daffan LLP in a class action invoking consumer protection laws that prohibit misrepresentation of products and services.
Daffan said, “This is a really good type of case for a class action, because the law is very clear that companies have to be honest about their advertising and marketing.”
She added, “It’s really not easy for a normal consumer to know if they’re getting the amount they were promised, or if they’re not, because that information simply isn’t provided.”
